GST Rules for the Digital Economy in Pune

Pune is home to tens of thousands of independent software developers, digital marketers, UI/UX designers, and e-commerce entrepreneurs selling on Amazon, Flipkart, Myntra, Swiggy, and Etsy. For these digital businesses, GST compliance operates under unique statutory rules that differ from traditional brick-and-mortar stores.

For baseline registration rules, read our complete guide to GST registration in Pune or consult our e-commerce tax specialists.

1. E-Commerce Sellers: Compulsory Registration under Section 24

Under Section 24(ix) of the CGST Act, any business supplying goods through an electronic commerce operator (ECO) that collects Tax Collected at Source (TCS) must obtain compulsory GST registration—even if their annual sales are only ₹10,000. E-commerce platforms will not activate a seller account without an active GSTIN.

2. Freelancers & IT Service Exporters: Export of Services via LUT

If you provide software programming, consulting, or creative services to foreign clients (via Upwork, Toptal, or direct billing) and receive payment in convertible foreign exchange (USD, EUR, GBP), your services qualify as an Export of Services under Section 2(6) of the IGST Act. Exports are treated as “Zero-Rated Supplies”.

By filing a simple annual Letter of Undertaking (LUT) on Form GST RFD-11, freelance IT exporters in Pune can export services without paying 18% IGST upfront, preserving 100% of their operational cash flow. Read our dedicated guide on filing a GST LUT for export of services.
